Is there anything that you cannot deal with?

Yes. There are some areas of complaint that Ombudsman Services: Property cannot deal with. These include:
  • complaints that would be better dealt with by the Courts;
  • complaints that are more appropriate for other dispute resolution schemes;
  • commercial or other business complaints;
  • complaints about a chartered surveyor or firm in England, Wales or Northern Ireland if the problem occured before 1 June 2007;
  • complaints about a chartered surveying firm or surveyor that provided a service to you in Scotland before 1 October 2003;
  • complaints about an estate agent if the problem occured before 1 October 2008;
  • complaints about a residential managing agent if the problem occured before 1 November 2009.

What we can and cannot do it set out in our terms of reference (our responsibilities). We will decide whether your complaint fits in with these terms and whether we have the power to deal with it.
